Terms of Service

1. Acceptance of Terms

By accessing or using EzReach ("the Service"), operated by Gibberish Tech, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including creators, brands, and agencies.

2. Service Description

EzReach is an Instagram automation platform that enables you to automatically reply to comments, send direct messages, and deliver links via Instagram DMs. The Service operates through Meta's official Instagram Graph API and complies with Meta's Platform Terms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use EzReach, you must:

• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Have a valid Instagram Business or Creator account connected through Meta's official authorization flow.

You are responsible for all activity that occurs under your account.

4. User Responsibilities

When using EzReach, you agree to:

• Comply with Instagram's Terms of Use and Community Guidelines.
• Not use the Service to send spam, unsolicited messages, or misleading content.
• Not use automations for harassment, hate speech, or any illegal activity.
• Not attempt to circumvent rate limits, API restrictions, or platform policies.
• Ensure that automated messages you configure are relevant and valuable to recipients.

Violation of these responsibilities may result in immediate account suspension or termination.

5. Ez Coins and Billing

EzReach uses a coin-based billing model ("Ez Coins"):

• Each automation run deducts 1–3 coins depending on the flow level configured.
• New accounts receive welcome coins as part of the free trial. No credit card is required to start.
• Coins can be purchased through our platform. Coin balances are non-transferable between accounts.
• Purchased coins do not expire as long as your account remains active.
• Refunds: Unused coin purchases may be eligible for a refund within 7 days of purchase, provided no coins from that purchase have been consumed. Contact support for refund requests.

6. Intellectual Property

The Service, including its design, features, and code, is the intellectual property of Gibberish Tech. You retain ownership of all content you create and configure (message templates, automation flows). You grant us a limited license to use your content solely to operate the Service on your behalf.

7. Account Termination

You may delete your account at any time from your account settings or by contacting support. We may suspend or terminate your account if:

• You violate these Terms or Instagram's policies.
• Your usage poses a risk to the Service, other users, or Meta's platform.
• Your account has been inactive for more than 12 months.

Upon termination, your access to the Service will cease and your data will be handled according to our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, EzReach and Gibberish Tech shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Loss of revenue, data, or business opportunities resulting from Service downtime or automation failures.
• Actions taken by Meta or Instagram against your account, including restrictions or bans, whether or not related to your use of EzReach.
• Any third-party claims arising from content you distribute through the Service.

Our total liability for any claim shall not exceed the amount you paid to EzReach in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation, specific results from automations, or that the Service will meet all your requirements.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
